AGREEMENT TO TERMS
By accessing or using the Paintly mobile application (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these Terms, do not use the App.
INTELLECTUAL PROPERTY RIGHTS
App Content
The App and its content, features, and functionality are owned by Paintly and are protected by copyright, trademark, and other intellectual property laws. The artworks displayed in the App may be subject to copyright owned by museums, artists, or other third parties.
Limited License
We grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use only.
Restrictions
You may not:
- Modify, copy, or create derivative works based on the App
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or other proprietary notices
- Transfer the App to another person or mirror it on any other server
USER ACCOUNTS
Registration
You may need to register for an account to access certain features. You agree to provide accurate information and update it as necessary.
Account Security
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device.
USER CONDUCT
You agree not to:
- Use the App in any way that violates applicable laws or regulations
- Use the App to transmit harmful code or interfere with its operation
- Impersonate or attempt to impersonate Paintly or any person
- Engage in any conduct that restricts or inhibits anyone's use of the App
SUBSCRIPTIONS AND PAYMENTS
Free Trial
If offered, the free trial provides access to premium features for the specified period without charge.
Subscription
Paid subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Cancellation
You can manage and cancel your subscription through your app store account settings.
DISCLAIMERS
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
LIMITATION OF LIABILITY
IN NO EVENT SHALL PAINTLY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
INDEMNIFICATION
You agree to indemnify and hold harmless Paintly from any claims arising from your use of the App or violation of these Terms.
CHANGES TO TERMS
We may revise these Terms at any time. By continuing to use the App after such revisions, you agree to be bound by the revised terms.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.
TERMINATION
We may terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
